Child Protective Services (CPS) is a state agency responsible for investigating allegations of child abuse. If CPS is convinced there is an ongoing risk of harm, they can remove your child from your home. When this occurs, CPS may ask a judge to set conditions (through a dependency petition) before your child can return home. You, your family, and CPS may not agree about where your child should be placed until things are sorted out. Michele will ensure your voice is heard throughout this difficult process, and that you are able to maintain some form of contact with your child.
If CPS contacts you, call Michele immediately. Any statements you or another family member make to CPS are not confidential and can be used as a basis to remove your child and file criminal charges against you.
Working successfully with CPS requires a balance of strong advocacy and cooperation. Through her years of working with CPS, Michele has developed an approach that will help shield you and your child from potential long-term negative consequences.
Complex Family Structures
Many families have unique structures and custody arrangements. Michele specializes in working with families of all types and is very capable of facilitating a cohesive approach. She is also experienced with custody disputes, discord within blended families, and families with foster or adopted children.
Dependency Petitions
If CPS believes a child has been abused, neglected, or is at risk, it can petition the court to ask that the child be removed from the home – either for a short time, or in extreme cases, permanently. Once a dependency petition is filed, the parent has the obligation to follow court orders. The court will review the case every few months to determine whether the child can be safely returned to the home. The court’s goal is reunification, and to ensure that parents follow through with services. Michele can represent you in a Dependency and advise you throughout this process.
